These Terms of Sale ("Terms") govern your purchase and use of in-app products, subscriptions, or services ("Products") offered through the Word Cloud Trivia mobile application ("App"). By making a purchase in the App or interacting with our Products, you agree to be bound by these Terms. If you do not agree with these Terms, do not make any purchases or use the Products. These Terms also apply to limited interactions with the App without a purchase, unless otherwise specified.
Word Cloud Trivia is owned and operated by Word Cloud Trivia LLC ("we," "us," or "our"). These Terms apply to all purchases made through the App, including one-time purchases, subscriptions, or other in-app transactions. All purchases are processed through the applicable platform (e.g., Apple App Store, Google Play Store) or, in some cases, a third-party payment processor, and are also subject to their respective terms and conditions. By using the App, you also agree to our Privacy Policy, which explains how we handle your personal information.
The App offers free Daily Challenges to all users. Premium features, including access to archived challenges and word cloud flashcards bundled by topic, are available through one-time purchases or subscriptions. One-time purchases provide access to specific bundles of archived challenges or flashcards, while subscriptions (monthly or annual) grant access to all archived challenges and flashcards. We reserve the right to modify the content, type, or availability of any Digital Product at any time. If you do not agree to such modifications, you may cancel your subscription as described in Section 2.1. Digital Product access is typically available within 24 hours of purchase, subject to payment verification. Only one person may use the account credentials associated with a Digital Product.
We process purchases as promptly as possible, but there may be delays while payment details are verified. We accept payment methods offered by the platform (e.g., credit cards, digital wallets) or third-party payment processors (e.g., Stripe, PayPal). Accepted payment methods vary by location. By providing payment information, you confirm its validity. We may receive updated payment information from your payment provider to prevent service interruptions, but you may opt out of this service through your payment provider. If a payment is declined or revoked, we may suspend or terminate access to the Product.
In some cases, we use third-party payment processors ("Third-Party Payment Processors") to bill you through your linked payment account. Payment processing is subject to the processor’s terms and privacy policies in addition to these Terms. We are not responsible for errors by Third-Party Payment Processors. By purchasing a Product, you authorize us, through the processor, to charge your selected payment method and agree to make payment using that method. We may correct processor errors even after payment is requested or received.
Prices for one-time purchases and subscriptions are displayed in the App in the currency applicable to your location and do not include taxes unless otherwise stated. Prices and billing frequency (e.g., monthly or annual for subscriptions) are confirmed at the time of purchase. Prices may change, but changes will not affect completed purchases. Discounts or promotions are applied at the time of purchase and cannot be applied retroactively. If a price is displayed in error, we may cancel or refuse the purchase and notify you to offer a refund or the correct price. Additional fees (e.g., telecommunications or data charges) may apply when using the App, and you are responsible for these costs.
We may offer promotional trials, discounted subscriptions, or referral programs ("Promotions"). Promotion terms will be specified at the time of the offer and may not be combined. For free trials, you must provide payment details to ensure uninterrupted access post-trial. Your subscription will automatically convert to a paid subscription at the end of the trial unless canceled as per Section 2.1. For promotional rates, you will be charged the promotional rate for the specified period, after which the standard rate applies unless canceled. You may only use one free trial or promotional rate per account unless otherwise stated.
For referral programs, eligible users may earn benefits (e.g., discounts or credits) by inviting new users to purchase a subscription. Benefits are non-transferable, non-redeemable for cash, and subject to verification. We may withhold, expire, or modify benefits if we determine your participation is fraudulent, illegal, or violates these Terms. We may terminate or change referral program terms at any time.
If a fee is not paid on time or your payment method is invalid, we may suspend or terminate access to the Product. You remain responsible for unpaid charges until the account is canceled as per Section 2.1. We may pursue collection of unpaid amounts, including associated costs (e.g., legal fees), to the extent permitted by law.
Archived challenges and word cloud flashcards (“Licensed Content”) are licensed, not sold. Upon purchase (via one-time purchase or subscription), we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access the Licensed Content for personal, non-commercial use. The license has no cash value and cannot be exchanged. If you close your account, you lose access to Licensed Content without refund unless required by law. We may modify or remove Licensed Content at any time. Violating these Terms terminates your license.
Purchases made through platforms (e.g., Apple App Store, Google Play Store) are subject to their terms, and we are not liable for claims related to such purchases. Contact the platform directly for issues with third-party purchases.
You consent to receive electronic notifications (e.g., billing confirmations, subscription changes) at the email address provided. You agree that electronic communications satisfy any legal requirement for written notices and that you can store such communications.
Subscriptions (monthly or annual) grant access to all archived challenges and word cloud flashcards and automatically renew at the end of each billing period unless canceled through the platform’s subscription settings or by contacting us. You authorize us to charge the subscription fee and applicable taxes on or after the purchase date or post-trial. Subscriptions continue until: (a) you cancel; (b) we decline to renew; or (c) these Terms are terminated.
You may cancel your subscription at any time through the platform’s account settings or by contacting us at support@wordcloudtrivia.com. Cancellation takes effect at the end of the current billing period, and you retain access to all archived challenges and flashcards until then. Cancellations during a free trial are effective immediately. If purchased through a third party (e.g., Apple App Store), you may cancel via their platform. Unless required by law, subscription fees are non-refundable, and no pro-rated refunds are provided for the remaining billing period. We may issue refunds or credits at our discretion, but this does not obligate future refunds.
For free trials, you will not be charged until the trial ends. Cancel during the trial to avoid charges. If you do not cancel, your payment method will be charged the subscription fee.
We may modify subscription terms, fees, or features (e.g., the scope of archived challenges or flashcards). If the price increases or benefits are reduced, we will notify you at least 30 days in advance, allowing you to cancel or change your subscription before the changes apply. Continued use after changes constitutes acceptance. If you change your subscription, we may apply a pro-rated credit for unused portions of the prior subscription toward the new one, at our discretion. Unused credits are forfeited upon cancellation.
We may suspend or terminate your subscription for any reason, including violation of these Terms, fraud, or legal requirements, with or without notice. If we cancel without cause, we may provide a pro-rated refund for the unused period. No refunds are provided if termination results from your violation of these Terms or applicable law.
One-time purchases (e.g., specific bundles of archived challenges or word cloud flashcards) are charged at the time of purchase and are non-refundable unless required by law or specified otherwise. We may issue discretionary refunds, but this does not obligate future refunds.

We may correct errors in Product descriptions, prices, or availability and cancel or refuse purchases based on such errors, notifying you with a refund or corrected price option.
We may suspend or terminate access to Products for violations of these Terms, fraud, or legal requirements.
All content and features in the Products, including text, graphics, and software, are owned by Word Cloud Trivia or its licensors and protected by intellectual property laws. Your purchase grants a limited, non-exclusive, non-transferable license for personal, non-commercial use.
To the fullest extent permitted by law, Products are provided "as is" without warranties, express or implied, including merchantability or fitness for a particular purpose. Use of the App is at your sole risk.
To the fullest extent permitted by law, Word Cloud Trivia is not liable for indirect, incidental, special, or consequential damages arising from your purchase or use of Products. Our total liability is limited to the amount paid for the Product.
These Terms are governed by the laws of Illinois, without regard to conflict of law principles. Disputes shall be resolved in the courts of Springfield, Illinois.
We may update these Terms, posting the revised version in the App with an updated "Last Updated" date. If changes materially affect your obligations or reduce our obligations, we will notify you at least 30 days in advance. Continued use or purchases after changes constitutes acceptance.
If any provision of these Terms is invalid or unenforceable, it will be severed without affecting the remaining provisions.
These Terms, our Terms of Service, Privacy Policy, and any additional terms presented at purchase constitute the entire agreement between you and Word Cloud Trivia, superseding prior agreements.
